Embezzlement
We also represented the owner of a construction company in a dispute with co-owners and third-party claimants on claims of embezzlement, breach of contract and breach of fiduciary duty. After engaging in extensive forensic electronic discovery, the opposing parties agreed to a $4 million settlement in favor of our client.
Restraining Order
We represented Southwestern Retail Properties, L.P., a secured creditor in a dispute involving a borrower and several third-party claimants, including multiple other lenders, vendors and landlords. After securing a restraining order that prevented interference, we assisted our client in taking possession of the premises and assets, eventually operating the business under authority of the court. After rationalizing operations, our client recovered the full $2.2 million it was owed as well as all attorney fees incurred. We then represented the client in purchasing the assets at auction which resulted in additional profit for the client. Finally, we represented the client in structuring the sale of the business to a strategic buyer for yet further profit.

Trade Secrets
We have years of experience representing individuals in disputes with their partners and with third parties, including breach of fiduciary duty claims, embezzlement, trade secret protection, non-compete clauses, fraudulent transfer claims. We also represent partners in dissolution proceedings as a result of misconduct and pursuant to dissolution agreements or by default as defined in the Business Organizations Code.

Non-compete Agreement
We represent entities and individuals in cases involving non-compete agreements, both to enforce them against former employees and the entities with whom they may now be working, as well as defending individuals and entities against enforcement. We also represent entities and individuals in disputes involving trade secrets and proprietary information and technologies.

We have handled many cases involving disputes concerning real estate, including failed or unconsummated transactions, ownership, conflicting rights, breached restrictions and covenants, and fraud and misrepresentation claims. Construction Litigation
We have extensive experience representing parties in residential, commercial, and industrial construction disputes, including claims for breach of contract, fraud, liens, breach of warranty claims, and tort claims related to the construction process. Many times, these claims are made years after the construction has been completed.
Eminent Domain
We represent individuals and entities in litigation concerning condemnation of real property and business interests by federal, state and local governments. We combine intimate knowledge of the procedures of eminent domain litigation along with our own valuation and proprietary data models to set the stage for successful negotiations or trial of condemnation disputes.

These cases involve not only expertise in litigation generally, but also awareness of the dynamics involved in interfamily disputes.
