Child Support
A Chapter 7 discharge refers to the successful elimination of unsecured debts, such as credit card debt, medical bills, certain loans and judgments, deficiencies on repossessed vehicles, and certain tax debts. Debts that can’t be discharged, or can only be discharged under special circumstances, include child support obligations, student loans, and a number of IRS tax debts.
Child Custody and Visitation
The Fifth Circuit Court of Appeals has also ruled that court-ordered payment of attorneys’ fees incurred in post-divorce / child custody litigation should be recognized as child support, and is also non-dischargeable.
Spousal Support
A debtor must make allowance in his Chapter 13 plan for payment of past due support obligations.Neither a Chapter 7 nor a Chapter 13 discharge affects future child or spousal support obligations. In other words, even at the conclusion of the bankruptcy proceeding, these on-going obligations remain.

DUI/DWI
The rules on which debts are discharged, or eliminated, are different depending on which type of bankruptcy is filed. A Chapter 13 discharge affects only those debts provided for in the plan. Additional exceptions to a Chapter 13 discharge include claims for spousal and child support; educational loans; drunk driving liabilities; criminal fines and restitution obligations; and certain long-term obligations, such as home mortgages, that extend beyond the term of the plan.

After completing the Chapter 13, your unsecured debts will generally be discharged, including credit card debt, medical bills, and private loans. Nevertheless, you will still be liable for any domestic support obligations, most student loans, certain taxes, most criminal fines and restitution obligations, certain debts and judgments for acts that caused death or personal injury, and certain long term secured obligations (such as your mortgage).

Bankruptcy
An Individual Chapter 7 bankruptcy is a petition to discharge (forgive) the debtor from his or her unsecured debts. This type of bankruptcy is designed primarily to help individuals with overwhelming debt and not enough income to pay back the debt.

MYTH #8: Creditors are Immune from the Bankruptcy and Can Still Sue You. This is absolutely false. In fact, one of the primary reasons to file Bankruptcy is to eliminate ALL debt collection activities. When you file the Bankruptcy petition, whether through Chapter 7 or Chapter 13, you and your property receive automatic protection from the Court against your creditors (known as the “automatic stay”), which also includes their attorneys, collection agencies, representatives, and/or agents. Federal law specifically prohibits your creditors from contacting you for any reason, including through written correspondence, monthly bills, or phone calls. Creditors must cease all collection efforts against you, meaning they cannot file a new suit, continue a prior lawsuit, or collect on a prior legal judgment.
