This policy is somewhat concerning to Memphis criminal defense attorney David Gold, who was asked to weigh in about the MPD’s use of body cameras in a recent WMC-TV story. Gold explains that while the Tennessee Open Records Act protects a citizen’s right to access and view any video footage that is captured by police body camera, access may be restricted in cases where an investigation is ongoing or the “video is of a graphic nature that has sensitive issues.”
DUI/DWI
A new piece of legislation made its way to the Tennessee House of Representatives recently but was voted down. According to MyFoxMemphis.com, the bill would have required people with three or more drunk driving convictions to have special notations placed on their drivers’ licenses. These notations would have prevented anyone from selling alcohol to them for as long as 15 years.
Wrongful Death
The most recent Federal Motor Carrier Safety Progress Report shows that there were more than 350,000 crashes involving commercial trucks, buses, and other commercial vehicles in 2018. These crashes can be devastating to both the accident victims and their families, causing severe injuries, wrongful death, and the pain and suffering that accompany both. Due to the size and weight of many commercial vehicles, the injuries suffered during these accidents often require long and painful recovery periods. Victims often need to take extensive time off work, and these injuries can also leave them incapable of taking care of their daily activities. If the victim has to rely on care from another family member, their earnings potential can be negatively affected as well. Bills pile up quickly in these situations, and life can quickly become overwhelming.
Traffic Violations
According to the Governors Highway Safety Association, red light cameras detect speeding motorists, as well as drivers who run red lights. Tennessee is one of 12 states in the nation that currently uses speed cameras in an attempt to deter, catch and penalize drivers who speed through intersections. A technologically advanced camera snaps an image of the vehicle as it speeds through the intersection or runs a red light. Not only does the camera store the image of the vehicle, it also reports the date, time and speed of the vehicle. The driver of the vehicle is then cited by mail and fined. According to the Gallatin Police Department, approximately 7,267 citations for running red lights were given in 2014 alone.

Hit and Run
After your car wreck, Tennessee law requires that you report the wreck to the police by calling 911. Whether you were hurt or not, the law requires you to wait for the police officer to arrive at the accident scene. Leaving the scene of an accident can be considered a “hit and run” and you can be charged criminally for leaving the scene of an accident. While you are waiting for the police to arrive, if you are able to get out of your car, take photographs of the accident scene showing as much detail about how the wreck occurred. Obtain contact information for any witnesses and look for any cameras on buildings near the wreck. Exchange contact information and insurance information with the other driver. From the accident scene call the Gold Law Firm at (901) 244-5003.

As pedestrians, we have every right to expect that drivers will yield the right of way and drive safely near us. If they fail to do so, severe and possibly fatal accidents can (and unfortunately do) happen.
