A wrongful death case is one brought on behalf of a deceased person’s survivors who alleges the death was attributable to the willful or negligent act of another. Catastrophic or permanent injury cases are those in which the plaintiff suffers one or more physical or mental impairments that will never go away. Practically all of our work involves cases where someone has wrongfully lost their life or is catastrophically or permanently injured. We limit our practice areas to cases involving these type situations. We spend a great deal of our time and resources developing evidence and testimony designed to clearly identify, portray and describe the unique circumstances of every case.
As long as individuals pay insurance premiums in a timely fashion, the insurance company generally acts “like a good neighbor”. Sometimes when the policy holder calls upon the insurance company to pay a claim, the policy holder may discover that he or she is not really “in good hands” as far as the insurance company is concerned. We represent clients with claims against their insurance carriers for bad faith denial of benefits and claims that should have been paid but were not. These claims can involve health/hospitalization insurance, life insurance, home insurance, and general property insurance claims.
A premises liability case addresses the liability of property owners for injuries occurring to another on their property. These cases may involve the failure to warn of a dangerous condition, inadequate security and other safety related issues.
Personal friends during the case and have remained so. My case was very difficult and presented serious legal challenges, but Bobby handled them with experience and confidence. Bobby hired a life-care planner to demonstrate what my cost of care would be for the remainder of my life. Additionally, other experts were hired to assist in the proving of my case that were invaluable in the final result obtained. Bobby is not only a man of great legal acumen, but an excellent strategist as well. I was very pleased with everything that was done by Bobby and Butch during my representation and would highly recommend them for all your personal injury needs.
Medical Malpractice
We prepare each case thoroughly and although each case may not require a jury trial, the attorneys at Jones and Smith are prepared to treat your case as if it did. In each medical malpractice case we work with highly qualified doctors and nurses whose credentials are recognized in their respective fields. In automobile accidents and/or tractor trailer cases we employ the best accident reconstructionists and other experts as needed in fields like conspicuity, weather, highway design, etc. We use medical illustrators to portray the injuries sustained by our clients. As a result of these efforts, the insurance companies (and jurors, if necessary) are educated regarding the extent of clients’ injuries as well as how the injury occurred. Several examples of exhibits and medical illustrations we have used in the past are set forth below...
