While most people think of probate only in the context of the division of property when an individual dies however, there are many other types of matters determined in the Probate Court. For example, the Probate Court may be called upon to appoint a conservator to act on behalf of an individual who is mentally or physically incapable of managing his or her own affairs. The Court also oversees the handling of various types of fiduciary accounts, including those of conservators, guardians, and differing types of trustees. The Court may also be called upon to appoint a guardian for a minor child or make determinations in paternity matters. Sometimes, the Court acts to terminate parental rights when parents are not fulfilling their responsibilities.

Criminal Defense
Richard A. Saliterman, Author, Reflections on the Presidential Clemency Power, 38 Oklahoma Law Review 257, 1985. This article deals with issues involved and considerations involved in granting by President Gerald R. Ford of clemency or pardons for civilian criminal law and military law offenses during or after times of war or insurrection. This article is written based on the author’s very brief experiences in this area at the conclusion of the Vietnam War while serving as a Lieutenant with the U.S. Navy Judge Advocate General Corps.

The Firm has commenced legal action and defended clients in securities fraud cases including one of the first cases involving the Bixby Energy scandal in Minnesota where investors were allegedly induced to invest in the coal gasification technology company based on representations that contracts and agreements had been reached between the company and certain State and Federal governmental entities. The Firm represented a family owned Minnesota radio station in a lawsuit brought against the station and one of its employees who alleged sexual harassment. The Firm counterclaimed for defamation and intentional infliction of emotional distress. The litigation resulted in a jury verdict of over $600,000 on for our client and the Plaintiff took nothing. The case is a national landmark case on the subject of emotion distress damages in the context of employment.
