In California, it is against the law to drive under the influence of alcohol and/or drugs (DUI). Unfortunately, that doesn’t mean that nobody drives drunk. In 2017 alone, 1,294 people were killed by drunk drivers, and an additional 26,967 people were injured. In that same year, 829 people were killed and 2982 people were injured by drivers who were under the influence of drugs.

Traffic Violations
If a driver violates a law that is meant to prevent car accidents, such as speeding, texting while driving, running a red light, or driving under the influence of drugs and/or alcohol, they may be considered “ negligent per se.†This means that they are presumed to be negligent (and thus liable for any injuries they cause). The driver can introduce evidence to rebut the presumption that they were negligent.

Anyone who is convicted of a DUI offense in California will face severe criminal penalties. Depending on whether the DUI is charged as a felony or a misdemeanor, the consequences of a DUI conviction may include jail or prison time, probation, mandatory alcohol education classes, steep fines and fees, and a driver’s license suspension. Drunk drivers may also be held financially responsible for any injuries that they cause.
Assault
Survivors can bring a wrongful death action for any type of accident or injury that was caused by another person’s negligence, gross negligence, recklessness, or intentionally wrongful conduct. Essentially, if a loved one dies because someone else did something careless or wrong, then their survivors may be able to file a wrongful death claim. Homicide
Importantly, heirs in a wrongful death action cannot recover punitive damages in almost all cases, which are meant to punish a wrongdoer for their conduct. The only exception is if the deceased was killed in a felony homicide for which the defendant has been convicted. However, punitive damages may be available through a survival action, as described above.
Hit and Run
