While inheritance disputes between siblings and claims from multiple marriages are the most commonly portrayed types of probate litigation, many cases often involve situations of mental incapacitation of the deceased during the time of writing their will. Psychological disorders such as dementia can cause an afflicted person to appoint the wrong fiduciary due to a false lapse of judgement. Other faulty planning mistakes such as creating a non-standard estate agreement can lead to more problematic cases down the road such as will construction suits, guardianship litigations, breach of fiduciary rights, and trust modification/reformation suits, all of which are applicable towards contesting the validity of a will.

Tying any loose ends together after the death of loved one, or even planning out what will happen to your estate and family after your own departure, is rarely a non-emotional scenario to face. In addition to the personal matters at hand, probate litigations come with a plethora of legal concerns as well as a quick response time to get all the appropriate paperwork together. Therefore, litigations in estate planning tend to be very urgent yet delicate matters at the same time while also requiring a tremendous amount of documentation.
There are many considerations individuals will have to make when contemplating filing for bankruptcy, and finding the right bankruptcy lawyer is just one of them. Depending on the circumstances, Chapter 7 or Chapter 13 bankruptcy may be the best available option. There may be circumstances where other options may need to be pursued not involving bankruptcy. Again, this is where hiring an experienced bankruptcy lawyer can help.
Foreclosure
The Chief Justice of the Cal Supreme Court issued an order on March 23rd indefinitely closing all California state civil courts until further notice. No one may file an eviction action for 90 days after the stay may be lifted by law except for evictions needed to preserve health or safety. Judicial foreclosure actions are similarly stayed. Yet there is no bar to proceed with non-judicial foreclosure, i.e., notices of default election to sell or notices of trustee’s sale. That might change.
Tax Law
Litigations in estate planning are urgent matters that require impeccable detail and a tremendous amount of documentation to complete. Peter Wittlin is a probate lawyer who can help navigate you through all the different steps with minimal complications. This can include expert guidance on asset protection, trust planning, income tax issues, and more.
