Before graduating he served in the United States Army where he received an honorable discharge. Mr. Shane passed the bars of Ohio and New York. His first job out-of law school was as an Assistant District Attorney in Kings County, N.Y. (Brooklyn). From there he moved to Cincinnati, Ohio where he began a private practice primarily as a criminal defense attorney defending major felony cases. In his first defense of a murder case in 1979 (State vs. Camper) Mr. Shane won an acquittal based on an insanity defense.

To assure privacy of one’s personal and confidential credit information is the other function and purpose of the Fair Credit Reporting Act. This is yet another critical reason for periodically monitoring one’s credit information. Your credit report may be viewed by others ONLY for a limited purpose. The consumer must make certain no one not having a permissible purpose under the Act to view your credit information does so. Impermissible access is the leading cause of identity theft. Monitoring one’s credit information on a regular basis in order to spot suspicious accounts or accesses will, in many instances, help to prevent future aggravation. However, not only must one look for suspicious tradelines in the body of their report, they must carefully review the account inquiry section of each of their reports for any strange or peculiar inquiries or for entities they don’t recognize. Obviously, securing the kind of personal information which allows thieves to more easily access your credit information is paramount as well.

Property Damage
Not every debt is covered by Act. The debt must be consumer debt. This means that it must arise from a consumer transaction. This generally includes a transaction primarily for personal, family or household purposes. Unfortunately, the Act won’t protect you against a debt collector attempting to collect a business or a commercial debt. Also, the collection of delinquent income taxes, penalties and fines are not covered. Generally speaking, debts which don’t arise from a contract such as those incurred as a result of an automobile accident where you cause property damage or personal injury to another are not covered. However, if you should enter into a written contract or agreement to pay this type of debt then, in our oipinion, the debt is probably covered. Bottom line, the vast majority of debts you will face will be covered by the FDCPA but some won’t.

Personal Injury
We can’t offer all the advice one needs in this little space but we recommend that you retain all repair or work orders issued to you each time your vehicle is brought in to the dealer. Take videos and photos which can illustrate and support your claims. I recently had a client who complained of violent vibrations where a video he shot clearly illustrated this. Keep a diary of each time you observe or experience the relevant symptoms just as you would if you were documenting your pain and suffering from a personal injury claim.

Bankruptcy
Typical Chapter 13 bankruptcy case: Client owes $50,000 in credit-card debt, $18,000 on a car loan, $5000 in medical bills, $3000 in delinquent taxes, and they are six months behind on their mortgage payments. The car payment is $475/month. We file a Chapter 13 case and the clients ends up paying $575/month for 60 months to solve all of the foregoing. The only change the budget is the addition of $1000 above the car payment to eliminate and manage $87,000 in debt. No debt settlement company can produce this sort of result.
Foreclosure
If your credit has been affected by late payments, lawsuits, garnishment, repossession, foreclosure, etc., then debt settlement is a waste of time and effort and money. Bankruptcy is always better – 100% of the time.
Debt Collection
Consumer Law lends itself nicely to class action treatment.Many such claims involve the use of preprinted contracts with identical language which may be unlawful or overreaching. Or the conduct alleged to be unlawful is the same over and over. Many individual consumer claimsinvolve amounts of money not large enough to neither justify the time nor expense necessary to bring such claims in Court. Nevertheless, these claims involve important legal issues which benefit consumers and which need to be addressed. Such claims brought on an individual basis provide little or no incentive for change where the wrongdoers simply pay small amounts which they consider as the cost of doing business. However, when similarly situated individuals combine their claims in a single lawsuit or action it can become a powerful force and incentive for change. Fortunately, many of the consumer statutes themselves expressly authorize and allow for class treatment for violations such as the federal truth-in-lending act, the fair debt collection practices act and many state consumer statutes as well.
