DUI/DWI
Traffic Violations
Driving Under the Influence of Intoxicants (DUII) is a common charge in Oregon. A police officer’s subjective belief gives him the authority to investigate someone he has pulled over for a traffic violation for a DUII, and arrest that person if he believes there is probable cause that the person has been affected by the consumption or use of intoxicants. This includes alcohol, drugs, or even prescription medications.
Sex Crimes
Since 1995, when Oregon Measure 11 was introduced, sex crime penalties have been severe. It is not unusual for a prosecutor to charge a number of sex crimes in an Indictment, and then seek to request the Court to run the sentences consecutively. Before 1995, a conviction for Sex Abuse in the First Degree would be a probationary sentence and maybe a little jail. Now, with Ballot Measure 11, there is a mandatory minimum prison sentence of 75 months. These are serious charges. It is my experience that most charges, from Sex Abuse to Rape, are based upon statements of a complainant by themselves with little or no physical evidence. There seems to be a rush to prosecute the most minor of allegations, which have major consequences.

I have been a criminal defense attorney for over 29 years, and have represented clients charged with serious crimes, including Aggravated Murder/Death Penalty cases, Homicide, Robbery, serious Assault, and Sex Offenses to all types of Misdemeanors. I have appeared in almost all Circuit Courts in Oregon and Superior Courts in Western Washington. I also serve as a Pro Tem Judge in a number of Municipal Courts, and have served as Secretary of the Clackamas County Bar Association, and a Delegate for the Oregon State Bar.
