Katherine began her legal career as an Assistant Appellate Defender in Ottawa, IL. In her role representing indigent defendants in their criminal appeals, Katherine determinedly fought to ensure that her clients’ constitutional and statutory rights were protected and ardently defended. She has argued countless cases in front of the Third District Appellate Court, and twice in front of the Illinois Supreme Court as a solo practitioner. One of Katherine’s Supreme Court cases created new law in Illinois by expanding 4th Amendment search and seizure protections.
DUI/DWI
Wrongful Death
Some of the most serious types of car accidents involve a vehicle turning over onto its side or roof. Rollover accidents can be incredibly dangerous, and they are likely to cause serious injuries to a vehicle's drivers and passengers. In fact, the National Highway Traffic Safety Association reports that even though rollovers only occur in 3% of all motor vehicle accidents, rollovers account for 33% of all car accident fatalities. If you have been injured in a rollover accident, or if your loved one has suffered a wrongful death because of a vehicle rollover, you will want to work with an experienced attorney to find out who was responsible for your accident and learn how you can receive payments that will address your injuries.
Traffic Violations
Distractions that affect drivers can include anything that takes a person's full attention away from operating their vehicle safely. Some forms of distracted driving are illegal, such as texting while driving or using a cell phone that is not in hands-free mode, and drivers can face traffic violations for committing these types of offenses. However, there are a multitude of other things that can cause distractions while behind the wheel, and all of them can be dangerous.
Sex Crimes
Residents at retirement homes or assisted living facilities can be seriously injured due to nursing home negligence. These injuries often occur because of inadequate staffing and supervision of patients, and they often involve abuse or neglect of patients. Failure to provide the proper care can cause residents to suffer injuries such as falls or bedsores. Patients may also suffer harm due to sexual assault, or lack of supervision may lead a person to suffer harm due to wandering either inside or outside a nursing home.
Misdemeanors

Assault
Murder
When an injury results in a person's wrongful death, the victim's surviving family members may pursue compensation from those who were responsible. In addition to covering costs such as medical treatment and loss of income, compensation may also address funeral and burial expenses, loss of companionship, and the grief and sorrow a family has experienced. Our attorneys can also help pursue compensation from a person who killed someone through violent crimes such as assault, homicide, or murder.
Homicide
Hit and Run
At Kanoski Bresney, we regularly work with clients who are injured by uninsured drivers, including in situations involving hit-and-run accidents. If there is one piece of advice we could give to help you make sure you are prepared to deal with an accident, it would be to purchase as much uninsured and underinsured motorist coverage as you can afford. The costs related to common car accident injuries can often exhaust the minimum amounts of insurance coverage, and having additional coverage can offer much-needed financial resources to help you recover from an accident.

Failure to uphold the duty of care: The defendant must have breached their duty of care. In product liability cases, a breach may involve a manufacturer's failure to provide warnings about the potential dangers of a product. In premises liability cases, a property owner may have breached their duty of care if they did not warn visitors about hazards on their property.
Eminent Domain
Todd received his Juris Doctor from Loyola University School of Law Chicago in 2005. For more than 10 years following law school, he served as a Special Assistant Attorney General for the Illinois Department of Transportation and Illinois Toll Highway Authority. In this trusted position, Todd litigated eminent domain cases on behalf of IDOT and the ISTHA. In addition, during this time Todd also served as a defense attorney in personal injury lawsuits. Todd also served as local liquor counsel for several high end hotels and restaurants, including the Palmer House Hilton, Hilton Towers, Hilton Rosemont, Hilton Chicago O’Hare Airport, Hilton Garden Inn Downton/Magnificent Mile, Waldorf Astoria Chicago, Virgin Hotels Chicago, The Langham, Andiamo’s, Potter’s Bar, Lockwood, Kitty O’Sheas, and 720 South Bar and Grill. In 2020, Todd decided to take his litigation skills and work for injured clients from the smallest case to the biggest case. He joined Kanoski Bresney because he had litigated a case against the firm many years ago and remembered the good fight they put up for their clients and the professionalism they displayed in and out of the courtroom.
Property Damage
Faulty or malfunctioning equipment can also lead to dangerous accidents. If a train's brakes, engine, couplings between cars, or other systems are not working correctly, or if railroad tracks or switches are not properly maintained, this can lead to dangerous collisions. In the worst cases, a train may derail, resulting in serious injuries to multiple parties and massive property damage.
While riding a motorcycle can offer fun and freedom, it also comes with risks. All motorcyclists are aware that a collision can be very dangerous, even when they are wearing the right safety gear. Cyclists throughout central Illinois face a wide variety of dangers due to the different types of roads, which can range from busy city streets to small-town intersections, interstate freeways, and remote state highways and country roads. No matter where a motorcycle accident takes place, a cyclist will want to work with a skilled personal injury attorney to figure out their best options for receiving financial compensation.

Auto Accidents
Dog Bites
A property owner or the tenant who is in control of a property is responsible for protecting the safety of visitors, and victims can pursue a premises liability lawsuit if they are injured on someone else's property. If hazards on a property are not corrected, or if visitors are not provided with warnings, injuries such as slips, trips, and falls may occur. Property owners may also be liable for dog bites or swimming pool accidents. Our attorneys can help victims determine their legal options in these cases, including injuries that take place at malls and stores, restaurants and bars, or daycares, schools, and childcare facilities, as well as situations such as bar fights and college campus assaults and accidents.
While in law school, Elizabeth clerked at criminal defense and estate planning firms. Although both were rewarding and educational, she was presented with several opportunities in which injured people needed legal representation. While working for a labor and employment law firm, she quickly realized that her true interests were in the area of worker’s compensation and personal injury law. Elizabeth has been helping others most of her life and after witnessing first-hand how cunning insurance companies ruthlessly profit from the fragile lives of everyday people, she felt outraged and will not stand for it. Elizabeth is proud to take up the fight against insurance companies so her clients can rest easier and focus on healing.
