Business Disputes
When a contract dispute arises we are often called upon by clients to advise them of their contractual rights and obligations and to represent their interests in mediation, arbitration and other forms of alternative dispute resolution proceedings that may be required under the contract. When alternative dispute resolution mechanisms are unavailable, our skilled and seasoned litigators represent clients in court proceedings involving contract disputes in many local and federal jurisdictions.

We concentrate on assisting clients in specific legal practice areas and have developed a prominent reputation in the United States and abroad for our experience and capabilities in handling matters involving all aspects of maritime commerce, marine oil pollution response and liability, commercial litigation, insurance and reinsurance disputes, commercial transactions, marine financing, inland transportation, yachts and recreational boating, and general casualty defense. The firm offers the depth of experience of one of the few dedicated admiralty and maritime law practice groups in the United States.
Construction Contracts
Mr. McCauley is a graduate of the United States Merchant Marine Academy, holds a U.S. Coast Guard Masterâ€™s license for ocean-going vessels and has served on twenty-two dry cargo, tanker, passenger, towing, and U.S. Navy vessels. For over 35 years he has handled virtually all types of maritime and related commercial and insurance disputes. His practice focuses primarily on major casualty, complex litigation and arbitration. In the maritime area, he specializes in personal injury and death claims, collision, pollution, general average, salvage, recreational boating and yachting, shipyard disputes, charter party and commercial disputes, marine finance and foreclosure. He also leads the firmâ€™s oil pollution and catastrophe response team. In addition, Mr. McCauley also has broad experience in the handling of both marine and non-marine insurance and reinsurance coverage disputes and litigation, including those involving hull, cargo, energy, marine, construction contracts and shipyard casualties. He has authored articles on foreclosure and has lectured on a variety of maritime and insurance law topics. Mr. McCauley is the former Chairman of the Recreational Boating Committee of the Maritime Law Association of the United States. He has served as an officer in the U.S. Naval Reserve and holds an air pilotâ€™s license from the Federal Aviation Administration.

Premises Liability
The firm is regularly appointed to defend the interests of businesses directly and through their insurers in a variety of cases involving general liability claims and property losses in state and federal court. Our attorneys are experienced in defending liability claims involving premises liability, motor vehicle accidents, dram shop claims, errors and omissions, property damage, toxic torts and products liability.
Construction Litigation
Mr. DeGiulio joined the firm in 1984 after obtaining his law degree and a masterâ€™s degree in business administration. After completing his undergraduate degree at the United States Merchant Marine Academy he obtained an unlimited tonnage Third Officerâ€™s license and a First Class Pilot license for the Great Lakes and served on numerous merchant and naval vessels and holds a Coast Guard. Throughout his legal career Mr. DeGiulio has handled all types of maritime casualty and commercial disputes primarily on behalf of shipowners and their insurers. His litigation practice focuses primarily on collision, oil pollution liability, charter party and commercial disputes, cargo and property damage claims, recreational boating casualties, Coast Guard violations and proceedings, marine finance and foreclosure, maritime liens, vessel arrest and attachment, general average and salvage. On the transactional side he also has extensive experience in the drafting of customized charter parties, contracts of affreightment, commodity supply contracts and vessel construction contracts, and regularly represents lenders and vessel owners in marine financing transactions. He is a leading member of the firmâ€™s oil pollution response team and has represented shipowners, charterers and terminal operators in administrative proceedings and litigation arising out of a number of major marine pollution incidents including the spills caused by the tankers GRAND EAGLE and ATHOS I. Mr. DeGiulio also has extensive experience in marine insurance coverage disputes and litigation and for seven years of his career represented insurers from around the world in connection with insurance disputes arising out of the EXXON VALDEZ oil spill. He has published articles on a variety of maritime law subjects including admiralty jurisdiction and shipownerâ€™s limitation of liability. Mr. DeGiulio is a former member of the board of directors of the Maritime Law Association of the United States and is a former chairman of the Associationâ€™s Recreational Boating Committee. He also serves on the board of directors of the S.S. UNITED STATES Conservancy. He formerly served as an officer in the U.S. Naval Reserve, achieving the rank of Lt. Commander.
Property Damage
Mr. O’Donovan joined the firm in 1984 after obtaining his law degree from Tulane University. He was born in England and spent his early childhood in South Africa before his family relocated to the United States. Mr. O’Donovan is a member of the firm’s oil pollution response team and has been involved in the handling of numerous oil spill incidents during his career. His maritime practice centers on cargo and property damage claims. He has been involved in the handling of a number of complex reinsurance and insurance coverage disputes, and also has extensive experience in the defense of toxic tort litigation involving environmental, asbestos and latex claims.

Personal Injury
The firm has extensive experience handing personal injury and cargo damage claims and other legal disputes involving motor carriers, rail carriers, warehouses and marine terminals and our attorneys are regularly retained by specialized insurers to provide advice and representation in connection with a variety of claims insured under inland marine policies of insurance.
Auto Accidents

Foreclosure
The admiralty and maritime law principles and the procedures which must be followed by a lender when a borrower defaults on a vessel loan and mortgage are highly unique. Our attorneys have extensive experience in advising lenders of their rights and obligations and, when necessary, prosecuting formal vessel mortgage foreclosure proceedings through the arrest of the subject vessel in federal courts throughout the country.
