Child Support
When you are involved in a divorce or separation from your spouse and you have children under the age of 21, the non-custodial parent who is earning an income, has the current ability and capacity to earn an income or has sufficient financial resources to pay child support, has a legal obligation to pay child support. In New York the Supreme Court Judge or the Family Court Judge will determine the amount of child support for children under the age of 21, who are not emancipated, if the parents cannot agree on the amount of child support that should be paid by the non-custodial parent.
Child Custody and Visitation
The custody of children is part of the divorce process in New York. Generally, when both parents can agree to the terms of child custody and visitation and can cooperate with each other about continuing to care for and raise their children, the children and their parents do better. However, it is not unusual for divorcing spouses to argue over whether they will agree to sole custody with one parent, joint custody with both parents having essentially equal decision making authority about their children’s major concerns, and the terms of visiting with the child, e.g. during the week, weekends, summertime and holidays. Often, lawyers and judges are needed to help resolve these matters.
Guardianship
“The presumption that a child resides with his or her parents or legal guardians can be rebutted upon a determination that there has been a total, and presumably permanent, transfer of custody and control to someone residing in the district (Appeal of Goldman, 46 Ed Dept Rep 224, Decision No. 15,488; Appeal of Palmieri, 45 id. 174, Decision No. 15,293). While it is not necessary to establish parental custody and control through a formal guardianship proceeding, it is necessary to demonstrate that a particular location is a child’s permanent residence and that the individual exercising control has full authority and responsibility with respect to the child’s support and custody (Appeal of Goldman, 46 Ed Dept Rep 224, Decision No. 15,488; Appeal of Palmieri, 45 id. 174, Decision No. 15,293).”
Spousal Support
The terms “maintenance,” “spousal support” and “alimony” are essentially the same terms that need to be considered as part of every New York divorce or separation of spouses. Divorcing or separating spouses can voluntarily agree to periodic payments of money to help support the spouse with lesser financial or earning capacity. If the parties cannot agree then a judge can order that one party pay the other party “spousal support.” There is no fixed amount of permanent spousal support that must be paid and there is no automatic right to receive permanent “spousal support.” The determination as to whether or not a spouse involved in a New York divorce or separation will receive “spousal support” depends on the discretion and judgment of the judge who will consider several factors before deciding whether or not to award spousal support.

A corporation is a legal entity that is separate and apart from the individuals who own, operate or manage it. In New York State the law allows you to be the sole owner of all of the stock in a corporation, manage the corporation and be the only employee of the corporation; however, if you organize the corporation, do business as a corporation and not as an individual and do not represent yourself to others as an individual who is doing business, but rather as an officer or employee of the corporation, you and the corporation should be considered as separate entities. Thus, if you properly form a corporation and transact business as a New York corporation you should be able to insulate yourself from liability for business debts and lawsuits for the corporation’s failed business transactions.
