Criminal Defense
Simply put, criminal defense lawyers perform a service to their clients. This is the same as any other professional providing a service. In these cases the lawyer serves as a guide through the overwhelming process known as prosecution. I take the job quite seriously and make sure that the one thing the client receives is my attention and time. If you call my office, I return the call. DUI/DWI
While I can't say that the circumstances of our meeting were enjoyable or positive, your support, knowledge, and assistance with my case certainly were. My case involved a DUI and several criminal charges, which could've resulted in extended jail time, loss of my job and license.
Traffic Violations
Client was charged with DUI and 3 counts of child endangerment as his 3 young children were in the car. Client faced a minimum of 30 days jail and, more importantly, loss of custody rights of his children and the possible loss of his license to practice dentistry. The investigation revealed that the person who reported the client as drunk and driving was a friend of his estranged wife. Other witnesses from the same party were located and painted a different picture. Additional information indicated that the wife and the arresting officers may have withheld evidence. On the eve of the motion to suppress evidence, the prosecution reduced the charges to reckless driving and a fine. Additionally the DMV did not suspend the client’s license after an administrative hearing.
Sex Crimes
Client was charged with one count of child molestation after his ex-girlfriend’s 10 year old daughter told her grandmother that the client was “very sexual”. This was immediately after the client had found her on the Internet looking at adult content and took the computer away. The investigation took off with the girl giving statements several times to police, the district attorney, CPS and a forensic child interviewer. Each time her stories about the sexual conduct of the client got more detailed and more sinister. She was given excessive attention prior to trial including being presented with a puppy a few days before. Once on the stand her stories became even more detailed and more sinister. When cross examined regarding her use of the Internet to view adult content she blamed the defendant and said he was the one who was looking at pornography. Robbery
Client charged with illegal possession of a firearm and had a previous juvenile strike conviction of armed robbery with use of a gun enhancement. Recent case law prevents juvenile strike convictions from being used on adults. However, the district attorney treated this as a strike prior in that they refused to make any pre-trial offer. Client was exposed to state prison. The defense filed a motion to dismiss for violation of the client’s right to a speedy trial. Defense team had interviewed witnesses who stated the police officer had made them guess when shown a photo line-up could not identify the client now as it had been almost 2 years since the incident.
Burglary
Client charged with burglary and grand theft after using fraudulent credit card to purchase electronics. This was quite serious for client as he faced deportation if convicted. Police gathered other evidence linking client to other similar crimes. Arrangements were made with the police department to return all of the stolen property. Client was granted diversion and served 3 days of community service.
White Collar Crimes
After graduation from law school, John spent two years with the Alameda County District Attorney’s Office assisting in the prosecution of white collar crimes. Since then, John has dedicated himself to defending those accused by both state and federal agencies. In the last 21-plus years, nearly 90% of this work involved accusations of sexual misconduct and other serious violent felonies.
Misdemeanors
The case against Suzanne Little was even weaker. Suzanne was offered a plea agreement to a misdemeanor that would be dismissed in 1 year. She responded, " HELL NO."
Embezzlement
Client was on parole for a strike felonies. Client’s former employer fabricated false accusations of embezzlement and grand theft in an effort to prevent the client from testifying in a civil case that was pending against the employer. Client was immediately arrested and sent to San Quentin to await a parole violation hearing. Client was facing a return to state prison for a maximum of 6 months. Client was released from custody after the initial detention hearing.
Drug Crimes
A joint task force of state and federal law enforcement served a search warrant on client’s home and seized a safe containing $100,000.00 cash. Investigation and discussions with the district attorney revealed that client had no idea that the safe contained contraband and he had no involvement in drug trafficking.
Assault
18 y/o client was charged with felony assault with a deadly weapon, terrorist threats, false imprisonment and domestic violence. Client was exposed to 6 years of state prison and 2 strike convictions. Investigation and preliminary exam testimony revealed that no weapon was ever found. The alleged victim’s testimony indicated that she was very inconsistent with her story about the use of a knife. Charges were reduced to simple assault and client was granted probation.
Murder
Evidence at the preliminary hearing regarding the element of ransom was severely lacking. The only evidence of ransom was that Suzanne Little and her then husband, Antone Aubrey, had not completely repaid a small loan from the Cook boy's father. Antone Aubrey had been acquitted at trial of the murder of the boy's uncle the year before, and Suzanne Little's now deceased sister, Joyce Croy, used to pester the boy's father for money and gasoline. There was no mention of any ransom demand or ransom notes. The law defines that ransom must be for financial gain. The holding order from the court was unsuccessfully challenged via writ to the appellate court on the grounds that proof of the element of ransom had not been met.
Identity Theft
Homicide
The cases were severed as the prosecution intended to use the Nelson statement in their case in chief. The law prevents co-defendant confessions to be used against another non-confessing defendant. Greg Nelson proceeded to trial ahead of Suzanne Little over the objections of her attorney. Despite having four deputy district attorneys qualified to prosecute a homicide case, the District Attorney used drug asset forfeiture funds to hire a special prosecutor for the Nelson trial.
Restraining Order
Client’s estranged wife and daughter falsely accused him of stalking and harassing the daughter by attending her soccer games and petitioned for a criminal restraining order against client. The case went to hearing where audiotapes of the incident showed unequivocally that the mother, stepfather and daughter lied to the court about the incident. Judge refused to issue the restraining order.
Kidnapping
At the preliminary exam the prosecution produced evidence that an eye witness saw the alleged kidnapping in 1976 and also witnessed the boy murdered by Greg Nelson in Hoopa. This particular witness was interviewed 4 separate times by law enforcement in 2008. Each time he gave a different story with greater detail down to what flavor ice cream he and his brother had on the day of the kidnapping. He never mentioned ever seeing Suzanne Little until the 3rd and 4th interviews. His mother was also interviewed in 2008. Curiously, the recording of her interview was not turned over to the defense until October of 2009 when Gregory Nelson was on trial. The officer responsible testified at trial that he had left the recording in his locker for over 1 year accidentally.
Manslaughter
Client was charged with grossly negligent vehicular homicide while DUI. Client was exposed to 22 years of state prison and two strikes, as there were two separate victims. The details of the accident were quite grisly as two people died in a fiery crash. By assembling a team consisting of an accident reconstructionist and 2 investigators, the defense was able to get the charges reduced to vehicular manslaughter while DUI and the client was granted probation and served a short county jail sentence. Further, the DMV did not suspend the client’s driver’s license after an administrative hearing where one of the investigating officers made misrepresentations regarding what he observed the night of the incident.
Prostitution
Client and her co-defendant were charged with soliciting prostitution and pimping/pandering after the massage studio was raided by state and federal law enforcement. This was a classic case of entrapment and withholding of crucial evidence by law enforcement. The local police and Office of Homeland Defense were looking for human trafficking of Asian women and came up short. Defense discovery demands were ignored by the prosecution and the court. Defense exercised right to a speedy trial. On eve of trial the prosecution reduced charge to disturbing the peace and a fine. Client avoided a conviction that had serious consequences to her immigration status. It was later revealed that the prosecution held back over 20 audiotapes from the defense.
Hit and Run
