Divorce

The issue of paternity comes up in several ways. A mother of a child may file an action against the alleged biological father to collect child support. Adoption
When seeking stepparent adoption you must first notify the child's other biological (noncustodial) parent â€” in most cases, termination of parental rights is required before a stepparent can adopt his or her spouse's child.
Paternity
Paternity issues may also arise in a divorce action where the parties are not sure of parentage. The determination of paternity is usually aided by blood or DNA testing. The most important thing to remember is that you only get one chance to litigate the issue of paternity. Once the issue is necessary to the pending litigation, it is a final determination of the issue between the parties, whether it is hotly contested, or ignored. For instance, if a party agrees to pay, pursuant to a divorce, child support for a child born to the parties during marriage, that party cannot later contest the childâ€™s paternity.
Premarital Agreement
A Marital Agreement can be made after the wedding whenever differences arise between the parties regarding the future financial issues. The Agreement must be based upon some consideration other than the marriage itself. Sometimes such an Agreement is made as part of a reconciliation of the parties or following some other dispute. Such an agreement has been held to be just as enforceable as a Premarital Agreement.

Legal Separation
There is a six-month residency requirement for filing a divorce. Out-of-state residents or newly arrived residents can file divorce against Georgia residents through Georgia courts. There is no legal separation period required, and the divorce may be filed on the date of separation. The parties may be considered separated for the purpose of divorce while continuing to live in the same house.
