Divorce
In 2004, Mr. Benson established his own law practice focusing his efforts on divorce law, family mediation and estate planning. Mr. Benson desired to provide legal counseling to the numerous couples suffering from divorce and minimize its impact on their children. Mr. Benson offered mediation as an alternative to so-called divorce wars before Illinois enacted law requiring mediation for those filing for divorce with children.
Child Support
In fact, these people generally pay â€œpennies on the dollarâ€ to unsecured creditors (i.e. credit cards, medical bills, payday/signature loans, etc.) and then receive various benefits in repaying debts they wish to repay (i.e. home mortgage and car loans) or that they must repay (i.e. most taxes, child support and student loans).
Spousal Support
All other debts must be listed on Schedules E and F. Your unsecured debts may include child or spousal support, taxes, credit cards, medical bills, and personal loans. You must list every debt on these forms, no matter how small or personal. Excluding a creditor could be perceived as fraud in the eyes of the bankruptcy court.

Traffic Violations
Restitution cannot be discharged under any circumstances, but fines can be in certain circumstances. The dischargeability of a fine is largely dependent on whether the intent of the fine is to punish you or compensate the government. If the fine is a punishment for wrongdoing, then it cannot be discharged. On the other hand, if the fine is designed to pay the government for monetary loss, then it can be eliminated. Bail bond forfeitures and income tax penalties over three years old are generally dischargeable. Furthermore, Chapter 13 allows for greater flexibility with fine discharges. Traffic violations, toll charges, building code violations, and parking tickets may all be discharged in a Chapter 13 case.
Fraud
A Trustee is assigned to every bankruptcy case that is filed. The United States Trustee Program is a component of the Department of Justice that seeks to promote the efficiency and protect the integrity of the federal bankruptcy system. To further the public interest in the just, speedy and economical resolution of cases filed under the bankruptcy code, the Trustee monitors the conduct of all bankruptcy parties and acts to ensure compliance with applicable laws and procedures. It also identifies and helps investigate bankruptcy fraud and abuse. Below is a list of Trustees, one of which will be assigned to your case. The Trustee will be assigned after your case is filed with the Court; you will receive this information from our office within a week after your case is filed, along with the location and directions to the meeting, date and time. Personal Injury
In Illinois, you can exempt (protect) up to $15,000 of any personal injury award or settlement that you may receive while filing a Chapter 7 bankruptcy to discharge your debts; however, payment for psychological or emotional injuries are not protected and any medical provider liens on the award are not discharged and must be paid from the award. Unfortunately, the state of Missouri has opted out from allowing debtors to take federal exemptions. Your personal injury award or settlement will not be exempt from bankruptcy if you are filling in Missouri.
