Child Support

Child Custody and Visitation
Modifications of custody and visitation can be brought by either party; however, there must be some substantial change in circumstances to do so. There are many reasons to change custody and visitation. The standard that a court must use is: What is in the best interest of the minor children!
Paternity
Premarital Agreement
Sometimes referred to as Antenuptial or Postnuptial Agreements, these contracts are becoming more popular, especially for 2nd marriages, or marriages between people who have high amounts of individual wealth. Some people are very disturbed by these types of agreements, but in many cases, they make perfect sense for both parties. If you have children from a previous relationship, you should consider entering into a premarital agreement before marrying, especially if you are older. You may ask why? One reason is simple. If you die and leave no will, the state will decide how your assets are divided. You cannot write a spouse out of a will.
Guardianship
Temporary Guardianships are issued by the Probate Court in Georgia. These consent agreements to temporarily transfer guardianship from one person to another can be entered into without judicial review, but once a Temporary Guardianship is entered into, it cannot be severed by the parent who entered into it without Court Approval unless the Temporary Guardian also consents.
Spousal Support
Alimony is still available in Georgia. In order to receive alimony, the spouse seeking it must prove that they need it and that the other spouse has the ability to pay it. Once these two thresholds are met, then other factors such as the length of the marriage, the income of both parties, and the reasons for the break up of the marriage are considered. Whether to award alimony is totally within the discretion of the trier of fact, the judge, or a jury. Georgia is one of the few states where you have the right to a jury trial.
Annulment
Annulment of a marriage is a judicial declaration that marriage was invalid from its inception. Many clients over the years have called and stated that rather than getting divorced, they wanted their marriage annulled. In Georgia, there are only limited circumstances where a marriage can be annulled and although you might like to have your marriage annulled unless you fit into these limited circumstances, the only legal way to end your marriage is through a divorce.

Chapter 11 is a reorganization plan for businesses and individuals with unsecured debts in excess of $336,900 and/or secured debts of $1,010,650. In Chapter 11, the creditors vote whether to accept the plan, where in a Chapter 13, the plan must be approved if it meets the statutory rules, whether the creditors like it or not. Chapter 11 is usually used to reorganize a business, that wishes to continue to operate, in a Business Bankruptcy, rather than a personal bankruptcy.

The easiest way to stop a foreclosure is to file bankruptcy. If you plan to stay in your house, filing a Chapter 13 is often the best solution.
