The Longshore and Harbor Workers’ Compensation Act (LHWCA) provides for compensation and medical care to employees disabled from injuries that occur on the navigable waters of the U.S., or in adjoining areas used in loading, unloading, repairing or building a vessel. The Act also offers benefits to dependents if the injury causes the employee’s death. The term “injury†includes occupational disease arising out of employment.

Medical Malpractice
Medical malpractice  is an act of carelessness either by physicians, or other healthcare providers. It is the breach of the accepted standard of care that is recognized by other providers who are practicing with similar training in the same field of medicine. Generally, injuries are the result of inappropriate action or a failure to act. Some examples would include: the administration of excessive doses of medicine; surgery on the wrong limb or organ; or, failure to remove surgical tools at the end of surgery.
