Criminal Defense
While at the Harris County District Attorney's Office I was assigned to the Family Criminal Law Division. This division of the DA's office prosecutes family violence offences including assault family member, assault family member #2, aggravated assault on a family member and violation of a protective order. While assigned to the FCLD division I learned how the DA's office prepares these cases. They are very specialized.
DUI/DWI
Generally speaking, if you are arrested for DWI the police officer is going to ask you to take a breath test. The Texas Transportation Code says that if a person refuses to give a breath specimen, their driver's license shall be suspended for 180 days. It also says that if a person gives a breath specimen and the result is an alcohol concentration of 0.08 or greater, the license shall be suspended for 90 days.
Sex Crimes
After law school, Dan went to work for the Harris County District Attorney's Office. While at the DA's office he tried more than 70 jury trials. Dan was promoted to Chief Prosecutor. He was responsible for supervising and training new prosecutors. Dan tried the most serious cases including murder, aggravated robbery, and aggravated sexual assault.

Drug Crimes
The 4th amendment is very important when it comes to drug cases. It says, "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." The United States Supreme Court and lower federal and state courts have interpreted the 4th amendment to mean many different things. This line of cases will be very important in determining if the evidence seized in your case is admissible in court and if the State can proceed with your case. Did the police have a warrant when they seized the evidence in your case? Did they need one? Was the warrant valid? Do you want a lawyer who knows?
