Fayette County Attorney Office

Child Support
Designed to help a person charged with the crime of Non-Support by helping them find employment, addressing substance abuse issues, etc. All with the end goal of collecting child support payments for the child.
Child Custody and Visitation
The legal obligation to pay child support is completely separate from the issue of visitation rights. If you are court ordered to pay child support, you must do so regardless of when or if you see the children. If there is a court order giving you visitation and the custodial parent refuses to let you see the children, your recourse is to file a motion with the court asking that he/she be held in contempt of court.
Paternity
Welcome to the Fayette County Attorney’s Office website. Our office touches the lives of virtually every citizen of Fayette County. With a staff of nearly 80 employees, including 23 attorneys, this office is responsible for prosecuting thousands of criminal cases each year in district court. This office is responsible for serving as legal advisor to the elected constitutional offices in the county, establishing paternity and collecting court-ordered child support, representing the Commonwealth in juvenile dependency, neglect and abuse cases, and assisting families with disability guardianship and involuntary mental health treatment for loved ones. Guardianship
The Fayette County Attorney helps people who are seeking guardianship or conservatorship for disabled loved ones in Fayette County. Kentucky requires a jury trial (in some cases a bench trial) to declare someone disabled. Our office presents the case to the jury and advocates for the appointment of a guardian or conservator.
Child Abuse
In Kentucky, cases involving child abuse initiated in Family Court are called “DNA” actions, which stands for “Dependent, Neglected or Abused.” Most child abuse falls into either the “neglect” category where the parent or custodian doesn’t adequately take care of the child or “abuse” where the parent or custodian physically or emotionally injures the child or allows someone else to physically or emotionally injure the child. When an act of child abuse is reported to the Cabinet for Health and Family Services or to law enforcement, investigative workers from the county office will begin an investigation.

Criminal Defense
R. Lee Greenup Lee Greenup was born and raised in Bourbon County, Kentucky. He graduated from Transylvania University, read postgraduate British history and government at Exeter College, Oxford and earned a J.D. from the University of Kentucky. He returned to his hometown of Paris, Kentucky and practiced for sixteen years, focusing on criminal defense. In October of 1999, he became an Assistant Commonwealth's Attorney in the Fourteenth Judicial Circuit and worked there until January 1, 2019, when he joined the Fayette County Attorney's Office.

Sex Crimes
After passing the Indiana Bar in 2011, Kate began her legal career as a Deputy Prosecutor in Ripley County, Indiana. In 2012, Kate moved home to Kentucky to become an Assistant Commonwealth’s Attorney in Kenton County. It was there that she specialized in child physical abuse, sexual abuse, and child pornography prosecution. In April 2016, Kate accepted a job in Lexington, Kentucky, as an attorney to the Kentucky Horse Racing Commission. In February 2019, Kate was promoted to Deputy General Counsel of the Kentucky Labor Cabinet. She is licensed to practice law in Kentucky, Indiana, and the federal courts in both the Eastern and Western Districts of Kentucky.
Robbery
The County Attorney’s Office prosecutes juveniles charged with status and public offenses. These charges include the status offenses of habitual runaway, habitual truancy and beyond control of parent or guardian. They also include public offenses (which would be criminal charges if filed against an adult), such as Theft by Unlawful Taking (shoplifting), Burglary, Assault, Possession of Marijuana, Minor in Possession of Alcohol, along with Robbery and Homicide. In very serious offenses, a juvenile defendant will start in Juvenile Court but may be eventually waived up to Circuit Court for the juvenile to be tried as an adult, if the statutory requirements are met.

John R. Hayne is the First Assistant County Attorney. He graduated from Paul Dunbar High School (Lexington). He is a 2003 graduate of Transylvania University with a B.A. in accounting, earned his master's degree in accounting from the University of Kentucky in 2004, and his law degree from the University of Kentucky in 2007. Prior to joining the Fayette County Attorney's Office in August, 2008, John was the staff attorney for Judge Thomas Clark of the Fayette Circuit Court. John was an Assistant Fayette County Attorney in the general prosecution division from 2008 t0 2018. During this time, John also served as a Special Assistant United States Attorney in the Lexington office of the U.S. Attorney from 2014-16 prosecuting federal crimes involving firearms, narcotics, and white-collar fraud. John has also served as a special assistant Commonwealth Attorney in Bourbon and Scott Counties where he tried cases to a jury for various felony offenses including Murder, Rape, Burglary and Arson. In addition to the practice of law, John has also served as a part-time instructor of accounting at Transylvania University. John has previously served as a board member of the Bluegrass Rape Crisis Center, The First Tee of Lexington, and the Transylvania Alumni Board. John is currently on the advisory board of the North Lexington YMCA Board, a mentor for the Transylvania 100 Doors program and the treasurer of You Matter Kentucky! (a juvenile treatment court program).

The Lexington Police Department does not have the ability or resources to investigate and file charges for every crime that occurs in Fayette County. For this reason, if a person is the victim of a misdemeanor crime, often times you (the victim) will need to come to our office to file a criminal complaint (“press charges”) against the suspect. The police investigate and charge all felony crimes.

Power of Attorney
A guardian may be needed when a person is unable to decide upon or take action needed to protect their health, safety, or well-being, The inability to look after their own interests may be due to the person’s age or illness, or because they never had such ability in the first place. Merely spending one’s money unwisely is normally not enough to require a guardian. When a person cannot understand the amount of their income or assets, or what their financial obligations are or how to meet them, the appointment of a guardian may be appropriate. However, the need for guardianship may be avoided by careful planning, including the use of a durable power-of attorney.

Letters are then sent to the delinquent tax payers advising them that the bills are subject to collection and addresses the possible results of non-payment, which ultimately include foreclosure.
Tax Law
The County Attorney also represents the PVA/Board of Assessment in any local tax appeals that have been filed with the Kentucky Board of Tax Appeals.
