Child Support
If neither of these voluntary procedures is an option, legal action may be necessary. A mother may file a paternity action to establish that the man she believes to be her child's father in fact is, or, if the mother is receiving public assistance, the state may initiate the action in order to recover its costs from the father. The putative, or probable, father's presence in court will be demanded, and he may be required to submit to DNA testing if he contests his paternity. Genetic blood test results are usually available within a few weeks, and they can establish (or negate) paternity with about 99 percent accuracy. If paternity is established in this manner, the court will enter an order regarding the father's paternity. The father then becomes legally obligated to pay child support according to the state's guidelines, which are generally based on both parents' incomes and the needs of the children. A father may also initiate legal action to establish his own paternity.
Child Custody and Visitation
Sometimes, the couple can voluntarily resolve all their issues regarding child custody and child visitation through mediation or settlement. California requires that parents go through this process.
Adoption
2. Adoption Agencies. Many birth parents and prospective adoptive parents work with licensed adoption agencies. The agencies sometimes match birth and adoptive parents. On other occasions, prospective adoptive parents put their family information in a book that is reviewed by birth parents, who then select the family in which they wish their child placed. Some adoption agencies can also facilitate international adoptions.
Paternity
When a child is born to a married couple, a legal presumption arises that the husband is the child's father. The same is not true with unmarried couples. Establishing paternity is important for unmarried couples in the event they break up and a parent seeks custody or child support, for inheritance purposes, and in a variety of other circumstances.
Premarital Agreement

With a premarital agreement, a majority of issues, especially financial issues, may already be resolved should a divorce become inevitable.
Guardianship
In 2003 the Legislature enacted Probate Code section 1516.5, making it easier for children in probate guardianships to be adopted by their guardians. Section 1516.5 authorizes the termination of parental rights when the guardianship has continued for at least two years, and the court finds that adoption by the guardian would be in the child's best interest.
Spousal Support
The couple exchanges documents and other information about issues such as property and income. By examining this information, the couple and the court can decide how to divide up property and how to deal with child support and spousal support (alimony).

Once paternity has been established, the child obtains many legal rights beyond child support. The child can inherit from his or her father, is eligible for health insurance coverage under the father's group policy, is entitled to social security benefits if the father dies or becomes disabled, may be entitled to wrongful death benefits if the father dies as a result of someone else's negligence, and can obtain medical history information, to say nothing of the emotional benefits-to both the father and the child-that may be reaped as a result of establishing paternity.

(d) For purposes of this section, a person has "perpetrated domestic violence" when he or she is found by the court to have intentionally or recklessly caused or attempted to cause bodily injury, or sexual assault, or to have placed a person in reasonable apprehension of imminent serious bodily injury to that person or to another, or to have engaged in any behavior involving, but not limited to, threatening, striking, harassing, destroying personal property or disturbing the peace of another, for which a court may issue an exparte order pursuant to Section 6320 to protect the other party seeking custody of the child or to protect the child and the child's siblings.

(c) No person shall be granted custody of, or unsupervised visitation with, a child if the person has been convicted of murder in the first degree, as defined in Section 189 of the Penal Code, and the victim of the murder was the other parent of the child who is the subject of the order, unless the court finds that there is no risk to the child's health, safety, and welfare, and states the reasons for its finding in writing or on the record. Restraining Order
(1) A party against whom a protective or restraining order has been issued excluding the party from the dwelling of the other party or the child, or otherwise enjoining the party from assault or harrassment against the other party or the child, including, but not limited to, orders issued under Part 4 (commencing with Section 6300) of Division 10, orders preventing civil harassment or workplace violence issued pursuant to Section 527.6 or 527.8 of the Code of Civil Procedure, and criminal protective orders issued pursuant to Section 136.2 of the Penal Code.
Kidnapping
3084. In making an order of joint physical custody, the court shall specify the rights of each parent to physical control of the child in sufficient detail to enable a parent deprived of that control to implement laws for relief of child snatching and kidnapping.
