Wrongful Death
There’s a procedural requirement in Minnesota where you first need to get someone appointed as trustee for the next of kin. That trustee is empowered to bring the wrongful death case on behalf of the next of kin.

Wrongful Termination
Wrongful termination is when someone is fired or let go from their employment for an illegal reason. Minnesota is an “at-will” employment state, which means that employers can fire employees for any reason, unless it is an illegal reason. Even if the termination is unfair, unethical, bad business practice, or just stupid, they are still within their rights to terminate you. However, this also allows employees to leave for any reason as well.
Employment Discrimination
Another firm brought us into an age discrimination case about 5 weeks before trial. The district court had previously dismissed the case, but the Court of Appeals reversed and remanded for trial. The defense made no offers of settlement. Though each of our 2 clients only had about $11,000 in damages each (as it was a failure to promote case, and they still had their jobs, so their wage loss was limited), the jury awarded $50,000 in damages to one plaintiff and $25,000 in damages to the second. The jury additionally awarded each plaintiff $25,000 in punitive damages – which is the statutory maximum allowed.

Severance Agreement

Slip and Fall Injury
Slip and Falls. When residents need help doing everyday tasks, they need a nurse on a regular basis. However, if there are hours at a time where no one sees them, the resident may try to do something on their own. If a resident is trying to get up to get a drink of water or use the restroom, they may slip and fall. Slip and fall injuries can cause trauma to the brain, neck, spine, and result in broken bones or severe sprains. The resident may not be able to get up by themselves and won’t get help until staff members realize what happened.
