DUI/DWI
Seeing a police cruiser’s lights flash on behind you can make your heart sink, but if you’re seeing this when you’ve just left an event where you consumed alcohol, it’s even worse. First you might wonder if you’re actually intoxicated, and then you’ll probably proceed to panic. When you find yourself facing DUI charges, an experienced New York DUI defense attorney can help.
Traffic Violations
Many people go through the unnerving experience of being pulled over on the roadway by a police officer. It may seem like a relatively minor inconvenience – you’ll just pay the ticket and get on with your life. The vast majority of those charged with speeding do just that and later realize that their car insurance rates increased.
Sex Crimes
Issuing a bad check is a misdemeanor. In New York, misdemeanors fall into two categories: Class A and Class B. Class A is the most serious, punishable by up to a year in jail and a fine of up to $1,000, although writing a bad check is a Class B crime that may result in up to three months in jail and a fine of up to $500. Assault, however, is most often classified as a felony. There are five classes of felonies in New York, punishable by anywhere from one year in prison to life behind bars, depending on the severity of the crime. Felony crimes include murder, robbery, rape or acts of terrorism. With both felonies and misdemeanors, the prosecution must prove beyond a reasonable doubt that the crime occurred and that the accused individual intentionally committed it.

Shoplifting
In New York, loss prevention employees have the legal right to detain customers they suspect of shoplifting. They may even use “reasonable force” to do so. They may also only hold you for a “reasonable” amount of time. After the loss prevention employee detains you, they must call law enforcement, who will decide whether or…
Many personal injury claims are filed as the result of a slip-and-fall accident, or premises liability. A New York property owner may be held liable for a serious injury if he or she neglected to remove snow and ice from a sidewalk, failed to mop up a spill, or knew about something that needed to be repaired but did not fix it and neglected to caution others about the problem.
If you have been injured as the result of someone else’s negligence in Sullivan county or Monticello, the attorneys at Scott Russell Law, Monticello Personal Injury Lawyer, can help you assert your rights. Our highly experienced team can determine what claims you may be able to file.
Medical Malpractice
In New York, you may be able to file a medical malpractice claim if you suffered an injury or serious illness because a doctor failed to act or acted negligently during the course of your care. The New York City Bar Association provides the following examples of medical malpractice: improper treatment, birth injuries, failure to diagnose or misdiagnosis, prescription mistakes, failure to monitor, surgical errors, and failure to inform the patient of risks prior to performing a procedure. In some cases, such as when a surgeon operates on the wrong side of the body or leaves a surgical tool inside the patient, medical malpractice is obvious. It may not be so obvious in other cases. If you believe you have been injured as a result of a medical mistake, please contact our attorneys today for a free consultation.
