The idea of integrating ADR within the judicial system is not a new idea. For example, mediation has long been used in resolving labor-management disputes. In the context of family law, mandatory mediation is required for child custody disputes. Individual courts have also implemented settlement panels, neutral evaluation panels and other mechanisms to resolve cases before trial. Moreover, other jurisdictions 16 have experimented with various types of court-annexed ADR. The Marin program thus derives in part from these and other precedents.
Guardianship
The skill and insight of an experienced mediator can bring a successful resolution far earlier and at less expense than other approaches to dispute resolution. More important, mediation improves the chances of preserving or even restoring the family relationship rather than destroying it. Often the future of the family hinges on how these issues are resolved. Approaching these disputes in a cooperative mediation process is more likely to produce a positive result for the family than the adversarial system. It is really the only forum with the potential to address the emotional issues that are usually at the core of the conflict.

Corporate Law
Arbitration Journal, December, 1990, that: "[a]s we enter the 1990’s, ADR expertise is an essential component of the package of services that a corporate law firm should provide its clients." (fn-6) If your firm does not provide critical services such as mediation, clients will utilize other firms who do. Howard Golub, general counsel for PG&E has made it clear to the attorneys PG&E retains that their performance would be evaluated in part on the basis of how or whether they utilize mediation.
Business Disputes
At Graham & James, Coombe launched an ADR education program when he joined the firm two years ago from Bank of America. As the bank’s general counsel, Coombe has pushed for the widespread use of arbitration and mediation in business disputes, and says that since he came to Graham several partners have become members of arbitration and mediation panels, particularly overseas.

Employment Contract
On the corporate side, Coombe sees a marked increase in the drafting of mediation and arbitration clauses for employment contracts, joint venture agreement, licensing agreement and other deals.

Rosenberg, who has given up his Mill Valley family law/personal injury practice to become a mediator, believes both the plaintiff and defense bars need to be educated about the benefits of ADR. “We need to talk about ADR as another weapon, another tool you need to give effective representation to your client,” he says. “It’s a competitive market out there; you have to be sensitive to it.”
