In 2002, Getnick & Getnick LLP was retained by the president of a California-based corporation in connection with the embezzlement of funds by the corporation’s Controller. This investigation, and litigation, was conducted in cooperation with the FBI and the local U.S. Attorney’s Office. It led to the criminal conviction of the Controller and a $40M civil judgment in favor of the corporation.

Since 1989, Getnick & Getnick LLP has been providing anti-fraud services to the New York City construction industry. For example, the private developer of a $26 million hotel construction project retained the firm following the murder of the project’s construction manager in its pre-construction phase. We uncovered and documented bid-rigging and commercial bribery activity leading to the compliance monitoring of sub-contracted work in progress, laying the groundwork for a prosecution by the New York County District Attorney’s Office for falsifying business records and tampering with evidence.

In carrying out the Court’s mandate, Getnick & Getnick LLP assembled a multi-disciplinary team of attorneys, forensic auditors and investigators and maintained an on-site presence at each of the three race tracks during its respective race meet. The firm monitored and reported on all aspects of NYRA’s business, from corporate governance and business operations to activities on the backstretch.

Managing Partner Neil Getnick was appointed an adjunct professor at Cornell Law School in the spring semester of 2013. Together with law school dean Stewart Schwab, he co-launched a course on “Whistleblower Law: Involving Private Citizens in Public Law Enforcement” – the first of its kind in the country – under the auspices of the law school’s Business Law Institute.

KBR: the US-based global engineering firm paid $579M for violating the FCPA by bribing Nigerian officials in exchange for engineering, procurement and construction contracts awarded between 1995 and 2004 to build liquefied natural gas facilities in Nigeria.

Tax Law
The Illinois False Claims Act, excludes actions brought under the Illinois Income Tax Act, but has been interpreted to permit other tax actions, including for violations of state sales tax provisions. Similarly, Indiana’s False Claims and Whistleblower Protection Act, excludes claims, records, or statements “concerning income tax” and Rhode Island’s False Claims Act, excludes claims under the Rhode Island personal income tax law.
