Divorce
Most marital cases are settled in part by court order, and in part by settlement. A case may be resolved entirely by negotiation and settlement. In this case the parties may submit a Judgment to the court accompanied with a declaration under FC 2336. The parties need not appear in court, and the trauma and emotional expense of litigation is avoided. An attorney's role here is important, both in structuring the agreement, and preparing the terms of the agreement. The key factors in favor of negotiated settlements are that the parties are in control of the outcome, children are not subjected to parents spending years in litigation and the result is that neither party feels an urge to capitalize on the other's future mistakes. Some cases have to be litigated though. Parties that adopt rigid, extreme positions, for example, compounded by a history of domestic violence or other behavior that causes distrust are seldom able to negotiate. This is why we have a court system staffed by sensible Judges.

Child Support
Both parents have the duty to support their children until they reach majority, or in some cases until the age of nineteen. A statewide guideline in terms of which child support is calculated is codified in Family Code Section4055. Various software applications are available, which generate a sum using the formula.
Child Custody and Visitation
This section is about the chapters in the California Family Code (FC) which address child custody laws in California and how the courts in California deal with child custody issues in paternity (uniform parentage), divorce, nullity and separation cases. This section also contains information about the policies behind California court decisions, the different kinds of custody - legal custody and physical custody - and the meaning of joint custody as contrasted to sole custody. I also refer to custody issues arising in move-away cases, and how courts approach custody issues by determining what would be in a child's 'best interests.' Reference is made to mediation and modification of child custody. The term 'custody' means physical and legal custody rights. Physical custody refers to who your child resides with, while legal custody refers to decision-making powers for a child regarding schools, development, medical insurance, finances and other issues. Joint custody means that you and the other parent share legal and physical custody of the child (FC 3002).
Adoption
Paternity
The California Family Code states that the legislature has an interest in establishing paternity for all children and establishing paternity is a step towards a child support award, which, in turn, provides children with equal rights and access to benefits, including, but not limited to, social security, health insurance, survivors' benefits, military benefits, and inheritance rights. Knowledge of family medical history is often necessary for correct medical diagnosis and treatment. Additionally, knowing one's father is important to a child's development.
Premarital Agreement

Guardianship
A non-parent might become the personal guardian of a minor child by bringing a guardianship action in the probate court. The custody factors applicable to a family law action are made applicable to a guardianship of the person action by reference to the Family Code. A court might provide for a guardian in where the situation makes it necessary and expedient.

Annulment
Other examples of way in which parentage may be establishes are written in FC 7611. Another way is if the presumed parent and the child's natural mother are or have been married to each other and the child is born during the marriage, or within 300 days after the marriage is terminated by death, annulment, declaration of invalidity, or divorce, or after a judgment of separation is entered by a court.

Criminal Defense
My mother was divorced and despite that she found funds to send me to the best schools in the City. At a young age I found myself staring at a legal letter which arrived from my father's lawyers. My mother did not show it to me - rather I discovered it. Nothing came of the dispute referred to in the letter. I continued to live with my Mom and visited with my Dad, whom I loved dearly, as he was a very busy architect. I have three children of my own. A divorce case is traumatic. I understand the trauma. Sex Crimes
A sizable portion of the California Family Code deals with the prevention of domestic violence. The reasons for these provisions are clear. Domestic violence divides families and all too often animals are left unprotected, abandoned and without a home when violence occurs. This may because of displacement, an arrest, or because parties are being sheltered. I support and welcome this addition to the Code. The Code defines domestic violence broadly in FC 6203: 'For purposes of this act, 'abuse' means any of the following: (a) Intentionally or recklessly to cause or attempt to cause bodily injury. (b) Sexual assault. (c) To place a person in reasonable apprehension of imminent serious bodily injury to that person or to another. (d) To engage in any behavior that has been or could be enjoined pursuant to FC 6320.'
Misdemeanors
In terms of California laws, based upon Federal Guidelines, the court shall issue a wage assignment order. Once served, the employer is obliged to garish the wages of his or her employee, and pays this sum of support to the obligee, and in some cases to a county officer who will forward the sum to the other parent. A parent who willfully fails to provide for his child may be charged with a misdemeanor in terms of PC 270. Other available enforcement actions include citations for contempt of court, as well as collection proceedings. Interest on support arrears is the statutory rate of 10%. Interest significantly increases arrears over time, especially if the arrears accumulate throughout the duration of the minority of the child. The Department of Child Support Services plays a role in collections and enforcement of support obligations.

Restraining Order
Animals are also protected. A person seeking a restraining order may seek to protect any animal, typically a pet dog or cat. The Code provides that "on a showing of good cause, the court may include in a protective order a grant to the petitioner of the exclusive care, possession, or control of any animal owned, possessed, leased, kept, or held by either the petitioner or the respondent or a minor child residing in the residence or household of either the petitioner or the respondent. The court may order the respondent to stay away from the animal and forbid the respondent from taking, transferring, encumbering, concealing, molesting, attacking, striking, threatening, harming, or otherwise disposing of the animal."
