Child Support
Florida Statute 61.30 contains the child support guidelines used to calculate a non-custodial parent's child support obligation. Child support is calculated by using the parents' net monthly incomes. A judge can deviate from statutory guideline amount by considering the following factors...
Child Custody and Visitation
The guiding principle in all cases involving custody and visitation is always "the best interest of the child." Judges do not want parents finger pointing at each other, but just want to hear the facts. For example, suppose a case involves a non-custodial parent who rarely visits with his/her child. The custodial parent should testify that the child would be better off seeing the other parent more often, rather than saying the other parent doesn't love the child or that it is wrong that he/she does not see the child more often. It is better that I do my clients' "dirty work" rather than having the clients cast stones.
Spousal Support
A judge must not include "premarital assets and debts" and "nonmarital assets debts" in equitable distribution. Assets/debts acquired before a marriage (premarital") and assets/debts acquired during the marriage, but from a source unconnected with the marriage ("nonmarital") and which remain titled solely in one spouse's name, are used as separate money, and, most importantly, are not comingled with marital funds are treated as one spouse's separate assets/debts. However, in unusual circumstances, a judge can use a person's premarital or nonmarital assets for lump sum alimony and/or for attorney fees to pay the other spouse assuming a great disparity of income between the parties and no other source of money being available to pay alimony or fees.

Criminal Defense
There are two types of domestic violence lawsuits - criminal (State of Florida versus person) and civil (person versus person). Although I have extensive experience regarding civil domestic violence cases, I do not represent individuals in criminal domestic violence cases. If you were arrested, your case is a criminal and you need to immediately hire a criminal defense attorney or have a public defender appointed. Under Chapter 742, Florida Statutes, "domestic violence" occurs if a person is physically harmed by a spouse, former spouse, boyfriend, girlfriend, etc. If there was no physical harm, "domestic violence" can still occur if a person is threatened with immediate physical harm, and the threat was such that a reasonable person would have been in fear imminent harm.
