Criminal Law

Criminal Defense
Attorney McBride attended St. Thomas University School of Law in Miami, Florida, where she earned her Juris Doctor (J.D.) degree. During her last year of law school, she was chosen to be a member of the Appellate Litigation Clinic and was certified by the Supreme Court of Florida. She wrote appeals in various areas of criminal law for the Public Defender’s Office, gaining knowledge and skills that would serve her during her law career.
Wrongful Death
The firm has handled diverse claims ranging from general motor vehicle negligence claims to cargo damages claims, catastrophic injury claims, wrongful death claims, contractual claims and claims for false arrest and malicious prosecution. Having represented both local and national transportation companies, our attorneys are well versed in the intricacies of both local/State laws and Federal regulations governing these clients’ businesses.
Traffic Violations
Gilbert, a plaintiff filed a legal malpractice claim against a defendant attorney for failing to advise of certain risks associated with a plea agreement to outstanding traffic tickets in municipal court. Under those circumstances, the Supreme Court concluded a reasonable jury could find that defendants breach of his professional duty was a substantial factor and thus a proximate cause of plaintiff’s harm. Subsequently, the Committee revised the charge, providing a definition to explaining foreseeability means whether a “similarly situated attorney would anticipate the risk that the attorney’s conduct would cause injury or harm to the attorney’s client.”
Fraud
The Office of the Attorney General states that insurance fraud costs each NJ resident $1,300 per year. Our presentation seeks to do the following: (1) outline fraud in the BI claim; (2) outline fraud in medical records/treating physicians; (3) discuss how to detect fraud; and (4) what carriers can do about fraud in the defense of BI Claims?

Camille R. McBride, Esquire is an Associate at Callahan & Fusco’s Florida office with more than 20 years of experience in litigation. She is licensed in Florida, District of Columbia, and Maryland as well as the United States District Courts in those jurisdictions. Ms. McBride’s practice concentrates on insurance defense and trucking accidents. Prior to joining the firm, she practiced intellectual property, entertainment, civil litigation, business law, bankruptcy, immigration, and family law.
Construction Contracts
A critical issue in most Labor Law claims is whether the client’s defense and indemnification can be successfully transferred to another party who performed work at the jobsite, whether pursuant to hold harmless or “additional insured” contractual provisions or through the “grave injury” exception in Section 11 of the New York Workers’ Compensation Law. Not only have we minimized exposure and accomplished total loss transfer in many cases, but we also have a track record of fully recovering the attorneys’ fees and defense costs expended on behalf of our clients from the indemnifying party. Our knowledge of these legal issues also enables us to draft construction contracts with appropriate indemnification and insurance provisions to protect our clients before work begins at the jobsite and potentially to avoid costly litigation should an accident occur.

He has represented public entities in Georgia and New Jersey in labor and employment, regulatory liability, and general liability disputes. Mr. Butler has represented plaintiffs in personal injury and employment litigation in both Georgia and New Jersey and has appeared before administrative bodies at every governmental level. He has obtained favorable results through summary dispositions, mediations, arbitrations, and trials.

Estate Planning
It is important that after working your whole life and providing for your loved ones, you do not leave them in a lurch without having prepared an Estate Plan for the disbursement of your assets or to handle your affairs (either financially or your health needs) in the event you can no longer do so. The Estate Planning Professionals at Callahan & Fusco, LLC will listen to your concerns, explain the legal choices you are facing and will assist you in creating a plan that makes sense to you.
Wills
Because you have a family that you should have a Will. You should control what happens to all that you have worked so hard to attain. You should decide who should be the Guardian of your minor children and take care of them physically and financially. A Last Will and Testament gives you control over your property so that you can help the who are important to you. If you do not have a Will, your assets will pass under the New Jersey laws of Intestate Succession after the Court names the person to take care of your Estate and that person posts an insurance bond to secure your assets.
Trusts
All Trusts are not subject to the probate process. Generally, Trusts are not subject to the probate process in New Jersey; however, if a person has a Testamentary Trust—a trust that is part of a decedent’s Will—it will be probated. Additionally, a Trust may be subject to a different kind of public notice. Trusts that involve real estate require a Memorandum of Trust to be filed with the County Clerk’s Office where the real estate is located; the specific Trust Agreement is usually not a public record. In addition, if you have a handicapped child you should consider establishing a “Special Needs Trust” to provide a benefit to the handicapped child without effecting government benefits. If a party files a litigation which involves the Trust, the Trust may become public record within a Court proceeding outside of the probate process.
Power of Attorney
Once I make out my Will, Power of Attorney and Living will, I won’t be able to change them. No. So long as a person is legally competent, a person is able to change their Will, Healthcare Directive, or Power of Attorney by simply making and properly signing new documents.
