Our firm is skilled in handling all aspects of commercial lending work and other real estate transactions throughout the State of Minnesota. George is a Certified Minnesota Real Property Law Specialist and represents several banks and other business entities in commercial loan transactions and other asset based lending transactions. George has also done extensive work with SBA Loans including involvement in the approval process and structuring and documenting the loan transaction. George and Robin have handled numerous residential real estate transactions including complicated document preparation, quiet title actions and other real estate litigation, closings, loan workouts, and other work relating to their elder law and disability planning practice. If the advance planning of you or your loved one goes awry or is not followed, we are also skilled in Probate and Trust Litigation matters. As former city attorneys, Robin and George have tried numerous cases and have used this experience to assist them in their Probate and Trust Litigation practice. Such litigation has included contested guardianship and conservatorship proceedings, will contests, trust litigation, legal actions to recover property, contests involving creditor’s claims, removal of fiduciaries for misconduct, and other probate contests. Often these matters involve very emotional issues for families and can be very disruptive to individuals and their loved ones. Our firm strives to resolve these contests outside of court and uses mediation and arbitration as a less costly alternative to a court proceeding. If the matter cannot be resolved outside of court, we will provide aggressive representation of our clients at all phases of the court process.
Trusts
Special Needs Trusts and Supplemental Needs Trusts allow disabled individuals the means to shelter their resources from the costs of necessary medical care while maintaining their eligibility for government benefits. They are also used to establish an individual’s eligibility for government benefits, such as Medical Assistance (Medicaid) and Supplemental Security Income (SSI). These types of Trusts are quite complicated and must be established in strict conformity with federal and state laws. Our firm is skilled in the process of establishing these trusts, maintaining them, and when necessary, assisting trustees with annual court accountings and court appearances.
Power of Attorney
Planning for the possible incapacity of you or a loved one can be a very emotional and complicated process. We will initially meet with our clients to discuss and develop an individualized plan that will be tailored to the specific needs and desires of the client. Developing an individualized plan for our clients usually involves several personal and financial planning tools. Such tools include health care directives, powers of attorney, trusts, wills, appointment of a representative payee, guardianship, conservatorship, use of technology such as direct bill paying, informal case management, and many other methods to protect you, your loved ones, and your assets. At Borer and Tomney Law we are familiar with these planning tools and are skilled in using them in assisting families in their overall planning needs. Our philosophy in developing a plan is to use the least restrictive and most cost-effective alternatives for our clients.
