Child Support
Under almost all circumstances, the California Family Law Courts use the California Child Support Guidelines, a complicated formula for which software is installed on every California Family Law Court Judge’s computer. Unless proven wrong for a particular set of circumstances, the court awards the guideline amount in child support cases.
Child Custody and Visitation
Probably by far the most volatile area of family law--child custody disputes-- can wreck havoc on a family. Studies have shown that high conflict around child custody can negatively impact children. If the parents are fighting over children, the children invariably know it. They feel badly enough that their family has separated. They have a difficult time going back and forth between their parent’s homes. Then, to have to witness their parents, whom they love, fight over them is a very traumatic experience. And costs--legal fees, experts, court appearances, etc. -- can skyrocket when there is conflict over child custody.

Premarital Agreement
A premarital agreement is one that is entered into before marriage and can affect property acquired both before and during marriage. Premarital Agreements are controlled by the California Uniform Premarital Agreement Act, contained in California Family Code Sections 1600 – 1620.
Spousal Support
Spousal support is typically ordered where one spouse or domestic partner earns more than the other spouse or domestic partner or when one spouse has not worked in several years, or does not work at the time of the separation.
Legal Separation
The divorce process is started by one spouse or partner filing a Petition, either requesting legal separation or dissolution of marriage, and usually containing attendant property division, child or spousal support and/or attorneys fee requests. The person who files the Petition is called the Petitioner.

Domestic violence is one of the saddest and most difficult area of marital or domestic partnership discord. One who alleges domestic violence is most often seeking a restraining order that keeps the perpetrator 100 yards from the person seeking the order. Violence or threat of violence must be proved. There is usually a hearing in front of a judge. It is important to have an experienced family law attorney defend you when charges of domestic violence are made. If a domestic violence order is made and issued, such an order can have lasting effects and can affect substantial rights, such as possessing a firearm. A finding of domestic violence may also have a significant impact on one's ability to obtain joint custody of a child or children. The law creates a presumption that the award of joint custody is NOT in the child's best interest when there is a finding of domestic violence. Often an allegation of domestic violence is the tail that leads the custody dispute.

Estate Planning

If the settlor may modify or cancel the living trust the trust is known as a revocable living trust.
Power of Attorney
Sometimes people cannot manage their financial affairs. This may occur for a variety of reasons including sickness, dementia, or other mental incapacity. Many of these persons will need a court appointed conservator to manage their affairs. However if you sign a durable power of attorney for financial affairs before you become incompetent then your agent (also known as your "attorney-in-fact") can manage your affairs for you, and a conservatorship may be avoided.
