Employment Contract
Chamber of Commerce v. Bonta, (Case No. 20-15291) 2023 WL 2013326 (9th Cir. Feb. 15, 2023), ruled that AB 51, a California law effectively prohibiting and criminalizing mandatory arbitration provisions in employment agreements, is invalid because it is preempted by the Federal Arbitration Act (FAA).
Employment Litigation
California employers should welcome this decision. The decision clarifies that businesses have broader freedom to contract as they see fit, and that it is permissible, even in California, to require employees to sign mandatory arbitration provisions as a condition of employment. The overall perception is that arbitration results in faster, less expensive resolution of employee-employer disputes, and keeps employment disputes out of California courts. Still, there are other schools of thought that believe that employment arbitrations can be more expensive for employers than the courts because private arbitrators often charge high hourly rates, the fees and costs of the arbitration must be advanced by employers, and dispositive motion victories (for example, a successful motion to dismiss a frivolous claim) are less common in arbitration. As well, even if arbitration is enforceable some employees may file their claims in court in the hope that the employer fails to take action to enforce arbitration.
Sexual Harassment
Defended a bookkeeper’s claims of sexual harassment, wrongful termination and employment discrimination against a military supplier who was pursuing claims of embezzlement against the bookkeeper. Â Resulted in settlements with no recovery for bookkeeper on her employment claims, and recovery for our client from the bookkeeper and two large banks of the entire amount of the embezzlement. Â We were able to utilize insurance proceeds to achieve settlement with net positive recovery for our client.

Conkle, Kremer & Engel also provides a wide variety of services to resolve disputes concerning construction, from construction defects to nonpayment, including liens and contractor licensing issues. Our lawyers are particularly attuned to the potential for insurance benefits in real estate and construction disputes, both for the costs of defense of claims and for any damages assessed. We have successfully resolved construction and real property disputes informally, as well as in arbitration and court trials.
Easement
Property Damage
Â Â Conkle, Kremer & Engel won an appellate court decision establishing a right of a subsequent property owner to collect insurance for damage to real property that started before the property was purchased. Conkle, Kremer & Engel represented a purchaser of a retirement park. The purchaser and the prior owner were sued by tenants who claimed property damage due to negligent construction. CK&E represented the purchaser against the contractor who caused the damage, and won a judgment at trial of $847,671. CK&E then filed an action to collect the $847,671 from the contractor’s insurer. The insurer refused to pay, contending that the purchaser did not own the property when the damage occurred. CK&E obtained a decision from the California Court of Appeal that the insurance company was wrong. The insurer is obligated to pay the amount of the award because the damage occurred during the term of the insurance policy, even though the purchaser did not own the property until later.
