Wrongful Termination
If an employee has an oral or written contract of employment specifying that he or she will not be fired without 'good cause'. If good cause does not exist, an employee who is terminated may have a claim for wrongful termination rooted in principles of contract law.
Sexual Harassment
Under California employment law, even if an employee has not been terminated, they may have a claim for "constructive termination" against the employer if the employee has been subjected to sexual harassment or discrimination.

Estate Planning
Estate planning ensures that your property is properly managed, accumulated, and distributed upon your death with maximum ease and minimal costs, delays, and problems. Additionally, estate planning allows you to provide for and designate guardians for minor children, plan for incapacity, medical care decisions, maintain privacy protection, and minimize or eliminate creditor claims.
Wills
Each of us must have a Will or Trust. While there are stark difference between Wills and Trusts, both legal documents allow us to direct where our property goes upon our death, and under what conditions they are distributed to our loved ones.
Trusts
Trust administration is the informal process of transferring one’s assets upon death, according to the instructions in the decedent’s Trust. Specifically, the Trust appoints a “Successor Trustee” who is authorized (without court) to handle the complete administration of the estate upon death. The Successor Trustee legally “steps into the shoes” of the decedent, meaning they can do anything the decedent could have done if they were alive, with the exception that the Successor Trustee must follow the decedent’s instructions set forth in the Trust document.
Power of Attorney
Each of us must have a Springing Durable Power of Attorney. This document allows us to select someone to manage our financial affairs and personal affairs when we cannot handle these matters ourselves (e.g., unconscious/incapacitated). If we become incapacitated without a Durable Power of Attorney, our loved ones, including our spouses, must go through the burden and expense of court (referred to as Conservatorship proceedings).
Probate
In 1995, Nicholas T. Montalto, founded and practiced law with the firm of “Santiago, Montalto & Rodnunsky,” with offices in Torrance and Woodland Hills, CA. As a principal with the firm, Mr. Montalto practiced extensively in the areas of Estate Planning, Trust and Probate Law. His practice also included extensive litigation, regularly handling over 25 litigation files at any given time, as well as serving as a lead counsel at trial. Mr. Montalto’s litigation work included both Plaintiff and Defense work, including many complex civil trials in the areas of employment law, wrongful death and injury, contact law, and trusts. Mr. Montalto also represented many clients and businesses, as a tax attorney.

Tax Law
Mr. Montalto brings an extensive background in tax law to the firm’s Estate Planning practice, differentiating him from many other Estate Planning attorneys. Additionally, because Mr. Montalto not only drafts trusts and Estate Plans, but litigates them in Court, he is provided a unique perspective in understanding the shortcomings of many trusts, and how to perfect them whether it be in the area of tax avoidance, creditor protection, or simply protecting the client’s wishes from being successfully challenged later in court.
