Maintenance, also called alimony or spousal support, is a monthly payment from one ex-spouse to the other. Maintenance is given to ensure that the lower earning spouse can support himself/herself and live the same lifestyle he/she had during the marriage. Maintenance is different than child support. Both are paid from one ex-spouse to the other, but maintenance is for the spouse and child support is for the children. The amount of maintenance that one ex-spouse receives, and the other has to pay, is determined by the income of each spouse. The longer the marriage, the longer maintenance is paid and received. For example, if a marriage lasts over twenty years then permanent maintenance may be ordered by the judge; if a marriage lasts less than five years than maintenance may be awarded for only a few months.
